Agreement to Terms

By downloading, accessing, or using HeadRest ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

Description of Service

HeadRest is a meditation application that generates personalized meditations based on your emotional context. The service includes:

• AI-powered analysis of your emotional situation
• Selection of relevant stories from wisdom traditions
• Generation of personalized meditation scripts
• Text-to-speech audio generation
• Meditation audio playback and library storage
• Curated meditation audio, Wisdom stories, and book-style reflection content
• Free and paid access tiers, including HeadRest Plus where available

Eligibility

You must be at least 13 years old to use HeadRest. By using the App, you represent that you are at least 13 years of age.

Account Registration

To use HeadRest, you must create an account using your email address. You agree to:

• Provide accurate and complete information
• Maintain the security of your account
• Promptly notify us of any unauthorized access
• Accept responsibility for all activities under your account

Acceptable Use

You agree to use HeadRest only for lawful purposes. You agree NOT to:

1. Submit Harmful Content

• Content promoting violence, self-harm, or illegal activities
• Content that harasses, threatens, or abuses others
• Content that is discriminatory or hateful

2. Misuse the Service

• Attempt to circumvent security measures
• Use automated systems to access the service (bots, scrapers)
• Reverse engineer or decompile the App
• Interfere with or disrupt the service

3. Violate Others' Rights

• Infringe on intellectual property rights
• Violate others' privacy
• Impersonate others

Content Guidelines

When entering your emotional context, please:

• Focus on your personal emotional experiences
• Avoid including personal information about others
• Use the service for its intended purpose (personal reflection and meditation)

The App includes content moderation to ensure appropriate use. Inappropriate content will not be processed.

User-Generated Content

Your Content

You retain ownership of any text you input into the App. By using HeadRest, you grant us a limited license to:

• Process your text to generate meditations
• Store your meditation audio files for your access
• Use anonymized, aggregated data to improve the service

Generated Content

Meditation scripts and audio generated by the App are:

• Created for your personal, non-commercial use
• Not to be redistributed, sold, or commercially exploited
• Subject to our intellectual property rights

Curated HeadRest content, including catalog meditations, Wisdom stories, book pages, images, audio files, and related text, is provided for personal in-app use only. You may not copy, scrape, redistribute, sell, bypass access controls for, or commercially exploit paid or locked content.

Mental Health Disclaimer

Crisis Content

If you input content indicating thoughts of self-harm, suicide, or immediate danger:

• The App will NOT generate a meditation
• You will be shown crisis support resources
• We encourage you to reach out to the provided resources

Intellectual Property

Our Property

HeadRest, including its design, features, content, and technology, is owned by us and protected by intellectual property laws. This includes:

• The HeadRest name and logo
• App design and user interface
• Meditation generation technology
• Curated story database

Stories and Traditions

Meditations reference stories from various wisdom traditions (Buddhist, Taoist, Stoic, Sufi, etc.). These traditional stories are part of humanity's shared heritage. Our unique contribution is:

• The curation and selection process
• The personalized application to your situation
• The script writing and audio generation

Fees and Payment

HeadRest may offer both free and paid features. Paid digital access, including HeadRest Plus if available, may unlock premium meditation catalog content, additional personalized meditation generation, Wisdom stories, book-style reflection content, and other Plus-only features shown in the App.

Paid access may be offered through in-app purchases or auto-renewing subscriptions processed by the Apple App Store or Google Play. Prices, billing periods, taxes, currencies, free trials, founder offers, promotional offers, and renewal terms are shown in the App or the applicable store before purchase and may vary by country, platform, eligibility, or time.

When you purchase through the Apple App Store or Google Play, payment is charged to your store account at confirmation of purchase. Subscriptions renew automatically unless canceled through your Apple App Store or Google Play account before the end of the current billing period. You can manage or cancel subscriptions using the subscription settings provided by the store where you purchased.

Canceling a subscription stops future renewals but does not automatically refund the current billing period. Refunds, billing issues, renewal timing, cancellation processing, and payment method management are handled under the applicable Apple App Store or Google Play policies. HeadRest does not process external checkout payments for digital access inside the App.

Access to paid features depends on the current subscription or purchase status reported by the applicable store and our entitlement systems. If a subscription expires, is canceled, refunded, revoked, transferred, or cannot be verified, paid access may be limited or removed while free features remain available where offered. If you believe your paid access is not reflected correctly, use the App's restore-purchase flow or contact support@tryheadrest.com.

Service Availability

We strive to provide reliable service but do not guarantee:

• Uninterrupted access to the App
• Error-free operation
• Availability of specific features

We may modify, suspend, or discontinue the service at any time with reasonable notice.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

1. THE APP IS PROVIDED "AS IS" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, or non-infringement.
2. WE ARE NOT LIABLE for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:
   • Loss of data
   • Loss of profits
   • Business interruption
   • Emotional distress
3. OUR TOTAL LIABILITY to you for any claims arising from your use of the App shall not exceed the amount you paid to us (if any) in the 12 months preceding the claim.

Indemnification

You agree to indemnify and hold harmless HeadRest, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from:

• Your use of the App
• Your violation of these Terms
• Your violation of any third-party rights

Termination

By You

You may stop using the App at any time. To delete your account, email us at support@tryheadrest.com.

By Us

We may suspend or terminate your access if:

• You violate these Terms
• We are required to do so by law
• We discontinue the service

Upon termination, your right to use the App ceases, and we may delete your data in accordance with our Privacy Policy.

Governing Law

These Terms are governed by the laws of India, without regard to conflict of law principles. Any disputes shall be resolved in the courts located in Bengaluru, Karnataka, India, except where applicable consumer law requires otherwise.

Dispute Resolution

Informal Resolution

Before filing a formal claim, you agree to contact us at support@tryheadrest.com to attempt to resolve any dispute informally.

Arbitration

If informal resolution fails, you agree that any disputes will be resolved through binding arbitration rather than in court, except for claims that may be brought in small claims court.

Class Action Waiver

You agree to resolve disputes on an individual basis only. You waive any right to participate in a class action lawsuit or class-wide arbitration.

Changes to Terms

We may modify these Terms at any time. We will notify you of material changes by:

• Updating the "Last Updated" date
• Displaying a notice in the App

Your continued use of the App after changes constitutes acceptance of the updated Terms.

Severability

If any provision of these Terms is found unenforceable, the remaining provisions will continue in effect.

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and HeadRest regarding your use of the App.
